Registration of a Co-operative - Western Australia

Description

You will require this registration if you intend to operate a co-operative in Western Australia. A co-operative is a legal entity formed by persons who intend to meet certain business, cultural and social needs through jointly owned enterprise. A registered co-operative is a body corporate and in Western Australia may be formed by a minimum of five individuals or corporations.

In forming a co-operative, members agree to use its services and to contribute capital to fund the enterprise, usually by purchasing shares. Funds are contributed not for capital gain but for service or trading benefits.

Co-operatives may be set up for a very wide range of social and economic activities, such as:

  • retailing
  • agriculture
  • manufacturing
  • child care
  • housing
  • marketing
  • arts and crafts
  • taxi services.

For instance, people in a rural community may establish a co-operative supermarket to buy food in bulk so that its members have access to cheaper goods.

Eligibility requirements

To be eligible for this registration, you must:

  • submit an application for an available name, using the approved application form
  • attach two copies of the proposed rules signed and certified by the persons who acted as chairperson and secretary at the formation meeting
  • lodge your application within two months of the formation meeting of your proposed co-operative
  • provide a statement listing the name, address, occupation and contact details of each person elected as a director
  • provide a certificate signed by the chairman and secretary verifying that you have been authorised to register the cooperative
  • submit annual reports
  • pay any relevant fees.
