You will require this approval if you intend to subdivide a lot of land, or amalgamate a lot with another lot. Your proposed subdivision will be assessed against the provisions of the relevant local planning scheme that applies to the land. Approval may be granted even though your subdivision conflicts with the provisions of a local planning scheme if:
- the local planning scheme is over 5 years old and the approval is consistent with a relevant State planning policy
- the approval is consistent with a region planning scheme
- the conflict is of a minor nature of the approval is consistent with the general intent of the local planning scheme
- the local government has not made any objections to the proposed plan of subdivision.
You may be required to comply with certain conditions prior to approval for your plan of subdivision being granted. This may include requiring you to first obtain development approval for building on the lot. Please consult the Contact Officer for more information.
