Work and Rest Hours Exemption Permit - Australian Capital Territory

Description

You will need this permit if you use a fatigue-regulated heavy vehicle and intend to operate beyond prescribed maximum work times or under minimum rest times.

A fatigue-regulated heavy vehicle is a:

  • motor vehicle with a gross vehicle mass (GVM) of more than 12 tonnes
  • combination with a GVM of more than 12 tonnes
  • bus that is fitted to carry more than 12 people including the driver.

Eligibility requirements

You may apply for this permit if you are:

  • an employer of a driver
  • a prime contractor for a driver
  • an operator
  • a self-employed driver.

You will need to show that the advanced fatigue management or basic fatigue management limits are not suitable and that the proposed work and rest times are safe.

You must ensure that the driver of the fatigue-regulated heavy vehicle has a copy of the exemption permit in their possession while driving.

To obtain this permit you must apply using the approved form and state the following:

  • the period for which the exemption is sought
  • any conditions
  • the name of the heavy vehicle driver
  • proposed maximum work times and minimum rest times.

You will need to provide any additional information requested by the Regulator.
