Busker/street performer licence (Mackay) - Queensland

Service summary

You need this licence to be a busker, or a street performer in selected areas within council boundaries. Types of business that commonly need this licence can also include musicians and jugglers.

Licences are issued subject to conditions, and only in designated areas. Noise complaints may cause the licence to be revoked.

Busking

playing a musical instrument and/or singing, conjuring, juggling, mime, mimicry, dance, puppetry, performance art, recitation and other appropriate theatrical and visual form.

Additional information

Conditions include:
  • busking is defined as planning a musical instrument and/or singing, conjuring, juggling, mine, mimicry, dance, puppetry, performance are, recitation and other appropriate theatrical and visual form
  • directions of members of the Police or authorised officers of the Council must be complied with at all times
  • permits shall not be held by persons performing on behalf of any political or religious organisation
  • the permit holder shall not advertise or associate himself or herself with advertising in conjunction with any performance
  • the use of amplifiers is prohibited
  • no nuisance shall be committed
  • there shall be no undue obstructions to pedestrian or vehicular traffic and entrances to shops and buildings shall be kept clear at all times
  • the direct collection or soliciting of donations is prohibited
  • the permit holder must not interfere in any way with an approved entertainment or activity
  • a permit holder shall not sell, offer or expose for sale any articles or commodity
  • concentrated periods of activity are not to exceed 20 minutes or 15 minutes duration with a break of 10 minutes to be provided between such periods. (It is strongly suggested you vary the locations of your performances.)
  • the permit holder is to vary the location of the performance ensuring that no business is in any way disadvantaged. As a guideline: no site should be used more than say 4 times in an 8 hour period.
