Real Estate and Business Agent Licence (Body Corporate) - Western Australia

Service summary

You will require this licence if your company intends to buy, sell, lease or manage real estate or a business on behalf of a vendor, landlord, purchaser or tenant in Western Australia.

A real estate licence is continuous, and does not require renewal. However, if you successfully obtain a licence, you will be grated a triennial certificate which entitles you to conduct your real estate business for three years. If you intend to continue to operate your business at the end of the three year period, you must renew your triennial certificate.

You may employ a person to act as your representative provided that person meets all the eligibility requirements for acting as an Agent's Representative and is registered as your Representative. Please note that as the licensed real estate agent, you are legally responsible for the actions of that representative.

Note that only a company incorporated under Australian Corporations Law may hold a body corporate licence.

Eligibility requirements

To be eligible for this licence:

  • all directors and managers of the company must be of good character and repute
  • at least one director must be licensed as a real estate and business agent. Where there are more than three directors, at least two of them must be licensed
  • each director must provide a national police certificate, and two written references affirming their good character, reputation and fitness to hold the licence
  • the person in bona fide control of the business must be licensed
  • the company must have sufficient material and financial resources to operate the business
  • submit the prescribed forms
  • pay the prescribed fees.
