Designated Outdoor Smoking Areas - Australian Capital Territory

Description

If you intend to create a designated outdoor smoking area (DOSA) on your licenced business premises, you must notify the agency within 14 days. Customers can drink and smoke in the DOSA but can’t be served food or drinks.

Ongoing eligibility requirements

You must:

  • have a smoking management plan which states how smoking is managed at the premise;
  • ensure no food or drinks are served in the DOSA (this includes clearing of glasses while someone is smoking in the DOSA);
  • ensure no food is consumed in the DOSA and;
  • ensure that there are no gaming machines or entertainment offered in the DOSA.

You must also display a public notice near the DOSA that shows:

  • that the area is a DOSA;
  • that persons less than 18 years old are not allowed in the DOSA;
  • that a smoking management plan is available for inspection and;
  • a diagram that sets out the boundaries of the DOSA.
