Home Business Approval - Australian Capital Territory

Description

You may require this approval if you intend to operate your business from a home that is subject to a residential lease agreement. The purpose of this approval is to ensure that the primary use of the premises is as a home, and the business remains a secondary purpose.

Licence

A licence defines the need to obtain recognition / certification and registration to undertake a certain business activity.

Exemptions

You may be exempt from this approval if you meet the following criteria:

  • No more than two people work on the lease at any time
  • Anyone who works there genuinely lives there
  • All goods relating to the business must be kept in structures lawfully on the lease and in a way that they cannot be seen from outside
  • The area of the lease used for the business is not more than forty square metres
  • Any vehicles at the lease for the purposes of the business are parked on the lease in a driveway or similar screened from the road
  • The business conduct complies with the Environment Protection Act 1997
  • Averaged over 7 days, the business does not generate more than 5 vehicle arrivals each day at the lease
  • Any sign relating to the business is exempt from requiring development approval
  • The conduct of the home business complies with the general exemption criteria that are applicable to the development.
