International Broadcasting Licence - Australian Government

Description

You will require this licence if you intend to provide international broadcasting services for either television or radio.

International broadcasting services are broadcasting services that are targeted to a significant extent, to audiences outside Australia where the services are delivered through the use of a radiocommunications transmitter in Australia. A broadcasting service must hold this licence for every international broadcasting service they operate before a transmitter apparatus licence will be issued.

You will not require this licence if:

  • the service only delivers programs packaged outside Australia
  • all relevant programming decisions are made outside Australia
  • the service is transmitted from a place outside Australia to an earth station in Australia for the sole purpose of being immediately re-transmitted to a satellite.

Eligibility requirements

To be eligible for this licence you must:

  • be a company that is formed in Australia or in an external territory
  • satisfy the Agency that your entity is a suitable applicant and does not pose a risk of committing an offence under the Act, civil penalties or licence breaches
  • provide a statutory declaration from an authorised person indicating your company's commitment to abide by the International Broadcasting Guidelines
  • pay the prescribed fee.

The Agency may reject the application if the Minister for Foreign Affairs is of the opinion that the international broadcasting service is likely to be contrary to Australia's national interest.

Ongoing eligibility requirements

A licensee must keep records of broadcasts for ninety days.
