You will require this registration if you intend to provide tax (financial) advice services for a fee or reward.

You are providing a tax (financial) advice service if you advise clients about the tax implications of any financial advice you provide.

A tax (financial) advice service is:

  1. a tax agent service (excluding representations to the Commissioner of Taxation)
  2. provided by Australian financial services (AFS) licensee or representative (including individuals and corporations) of an AFS licensee
  3. provided in the course of advice usually given by an AFS licensee or representative
  4. related to ascertaining or advising about liabilities, obligations or entitlements that arise, or could arise, under a taxation law
  5. reasonably expected to be relied upon by the client for tax purposes.

A licence defines the need to obtain recognition / certification and registration to undertake a certain business activity.

Eligibility requirements

You may apply for registration as a tax (financial) adviser as an individual, partnership or company.

You must be either:

  • a qualified tax relevant provider registered with the Australian Securities and Investments Commission, or
  • a tax agent registered with the Tax Practitioners Board.

To be granted registration, the Tax Practitioners Board (TPB) must be satisfied that you:

  • are at least 18 years of age
  • are a fit and proper person
  • satisfy the qualification and experience requirements
  • maintain, or will be able to maintain (once registered), professional indemnity insurance that meets the TPB's requirements.

Ongoing eligibility requirements

To maintain your registration as a tax (financial) adviser, you must:

  • complete an annual declaration to show you meet your ongoing registration obligations, including meeting the TPB's professional indemnity insurance and continuing professional education requirements
  • comply with the TPB's Code of Professional Conduct
  • notify the TPB when your registration details or circumstances change
  • renew your registration on time.
