Strata Subdivision Certificate (Leasehold Development) - New South Wales

Description

You may require this certificate if you intend to subdivide and develop land. It is required prior to registration if you intend to create, amend, consolidate or cancel a leasehold development or staged development.

The approval of a leasehold development enables the future registration of the specified property. A leasehold development is a development involving the registration of a series of lots which are to be leased, rather than purchased. Strata plans are property divided into lots (private property) and common property. The common property is managed by a body corporate, which is all the lot owners acting as a single body.

A leasehold staged development scheme is a development involving the registration of a series of strata plans that are to be leased.

This is part of a two-step approval process for leasehold developments, specifically:

  • First you must obtain a certificate of approval in principle from the relevant consent authority; and
  • You must lodge your leasehold development scheme with the relevant State Government Agency.
