Aboriginal Heritage Impact Permit - New South Wales

Description

You may need this permit if you intend to conduct an activity that will directly or indirectly harm an Aboriginal object or place. Gaining this permit will allow you to carry out your activity without incurring penalties.

The permit may impose conditions on your proposed activities.

You may not need this permit if your activity:

  • was authorised by or under the State Emergency and Rescue Management Act 1989
  • was authorised by or under the Rural Fires Act 1997in relation to emergency fire fighting or bushfire hazard reduction work
  • was required or permitted under a conservation agreement entered into under the NPW Act
  • was required for the conservation or protection of an Aboriginal object or Aboriginal Place and was carried out by Heritage NSW or person under the direction of that officer
  • occurred while an Aboriginal person was undertaking a traditional cultural activity (not a commercial activity).

Eligibility requirements

You must complete the following activities in order for your application to be considered:

  • prepare a cultural heritage assessment report that meets the specified requirements
  • complete an Aboriginal community consultation process
  • complete and submit the application form
  • provide any additional information to support your application, including site information for the Aboriginal Heritage Information Management System (AHIMS).

Duration

The permit will remain in force for a specified term, as set out in the conditions.
