Approval and Registration of a Community Scheme (Subdivision) - New South Wales

Description

You will need this approval and registration to create, amend, consolidate or cancel a community scheme development. A community scheme development involves the creation of a subdivision (multiple lots) that all have access to common or shared property.

This is part of a two-step approval process for a community scheme development:

  • First, you must obtain approval in principle from the relevant consent authority.
  • Second, you must lodge your community development scheme with the relevant State Government Agency.

The approval in principle of a community scheme development enables the future registration of the specified property that is to be developed.

Service type

Licence

A licence defines the need to obtain recognition / certification and registration to undertake a certain business activity.

Eligibility requirements

You are required to provide evidence of consent authority approval for your scheme in addition to other specific information for final Agency registration.

Registration may be refused if you:

  • define lots that are part of, or semi-detached from, a building
  • only provide associated property that is unavailable to lot owners (for example, limited to soil or airspace).

In these circumstances, you should instead apply for registration of a strata scheme.
