You need to notify council if you operate a public swimming pool or spa. A swimming pool or spa is considered to be public if:
- the public is admitted as an entitlement of membership of a club
- it is provided at a workplace for the use of employees
- it is provided at a hotel, motel or guest house or at holiday units, or similar facility, for the use of guests
- it is provided at a school or hospital
- it is on private premises and used for commercial purposes.
You must ensure that the swimming pool or spa and the surrounding area is kept clean (i.e. in such condition as to minimise the transmission of disease).
