Authority to Fundraise for Charitable Purposes - New South Wales

Description

You will need this authority to raise more than $15,000 in a financial year for a charitable purpose.

A charitable purpose is a broad term that can change depending on perceptions of social needs and attitudes. Charitable purposes can be grouped under the following broad headings:

  • relief of financial hardship
  • the advancement of education
  • the advancement of religion
  • other charitable purposes beneficial to the community.

Fundraising may take a variety of forms and includes: donations, sponsorship, telethons, lotteries and competitions, supply of food, supply of entertainment, supply of other goods or services, in connection with any commercial undertaking.

Please note that if you are registered with the Australian Charities and Not-for-Profits Commission (ACNC) and have notified them of your intention to fundraise in NSW, you can automatically operate in NSW under a 'deemed authority'.

Eligibility requirements

To be eligible, you must:

  • be aged 18 or over
  • lodge an application form (unless operating under a deemed authority)
  • comply with the information described in the attached guidance materials, including the National Fundraising Principles and the NSW Standard Conditions.

Ongoing eligibility requirements

Unless operating under a deemed authority, authority holders must submit the following information within six months of the end of the financial year:

  • an annual return
  • an annual financial statement
  • a compliance statement.

This is a requirement even if no money was received and no fundraising appeal was conducted during the financial year. If you raise $250,000 or more in a financial year, you must also submit an auditor's report.
