Conveyancer's Licence - Corporation - New South Wales


A corporation will require this licence to carry on a conveyancing business where conveyancing work is undertaken for fee or reward. Conveyancing work is legal work carried out in connection with any transaction that creates, varies, transfers or extinguishes a legal or equitable interest in any real or personal property - for example, sale or lease of land, sale of a business, grant of a mortgage. A full definition of conveyancing work is contained in section 4 of the Act.

Note, this licence does not apply to the conduct of a conveyancing business by an incorporated legal practice or solicitor corporation (if the conveyancing business is carried on, on its behalf by an Australian legal practitioner).

Eligibility requirements

To be eligible for this licence, the corporation must:

  • submit an application form
  • each director must be a fit and proper person to hold a licence
  • no director or officer of the corporation is to be a disqualified person
  • the corporation must be fit and proper to hold a licence
  • the corporation must not be disqualified under the Act
  • at least one of the directors of the corporation holds an individual conveyancer's licence
  • be covered by an approved professional indemnity insurance policy
  • pay any required fees.
