Corporation Licence - New South Wales

Description

You will need this licence if you intend to operate a corporation that carries on the business of a real estate, stock and station, or strata managing agency:

  • a real estate agency undertakes activities such as the auctioning, selling or leasing of land or property, collecting rent from leased properties and managing leased properties
  • a stock and station agency undertakes activities such as the auctioning of rural land or stock
  • a strata managing agency undertakes activities in relation to the owners' corporation of a strata scheme.

A licence defines the need to obtain recognition / certification and registration to undertake a certain business activity.

Eligibility requirements

To be eligible for this licence:

  • the director and secretary of the corporation must be considered fit and proper person for the purposes of the licence
  • no director or executive officer may be a disqualified person (as defined under the Act)
  • at least one director of the corporation must hold a current licence and nominate a class 1 licence holder in the relevant category held by the licence director, to be the licensee in charge
  • relevant contributions must be paid to the Property Services Compensation Fund
  • the place of business must be in New South Wales or within 50km of the New South Wales border if you hold an equivalent interstate licence at that interstate address.
