Licence to Conduct Public Lotteries - New South Wales

Description

You will need this licence to conduct public lotteries. A public lottery is a game of chance in which a person chooses or is allocated numbers drawn at random. The aim is to correctly match the prize winning numbers. Public lotteries include:

  • Lotto
  • OzLotto
  • Keno
  • Powerball
  • Lucky Lotteries.

An instant scratch lottery is also a public lottery, however in the absence of a draw, certain numbers are designated as prize winning numbers or tickets.

In order to conduct a public lottery, you must obtain two licences. You must first obtain an Operator Licence, which grants you in-principle approval to conduct a public lottery. You must then obtain a Product Licence for any particular public lottery you intend to conduct. A Product Licence cannot be obtained without first obtaining an Operator Licence.

Eligibility requirements

To be eligible, your corporation must demonstrate that:

  • you are a licensed lottery operator
  • you and each of your close associates are of good repute, and have a sound and stable financial background
  • you have, or have arranged, a satisfactory ownership or corporate structure
  • you have or are able to obtain financial resources that are both suitable and adequate for ensuring the financial viability of the lottery business
  • you have or are able to obtain the services of persons who have sufficient experience in the management and operation of a lottery business
  • you have sufficient business ability to establish and maintain a successful lottery business
  • you have sufficient technical expertise and resources to conduct lotteries of the kind to be conducted as part of the lottery business
  • neither you nor any of your close associates have any business association with any person, body or association who is not of good repute or has undesirable or unsatisfactory financial sources
  • each director, partner, executive officer and secretary and any other officer or person associated or connected with the ownership, administration or management of the operations of the lottery business is a suitable person to act in that capacity.
