Mining Lease - New South Wales

Description

You will need a mining lease to extract minerals for the purpose of commercial mining. A mine is any artificial or naturally occurring place, pit, shaft or other excavation where the extraction of minerals from the ground occurs.

Due to the potential for environmental harm that may be caused by an incorrectly operated mine site there are stringent planning processes that must be complied with for your application to be successful. In addition to this, if your lease application is granted it will be subject to a number of conditions which may relate to:

  • mining or mining operations
  • transporting of materials or equipment used for mining
  • treatment or preparation of minerals prior to sale
  • disposal or storage of waste generate from the extraction of minerals
  • activities that are conducted in the vicinity of the mine site.

A licence defines the need to obtain recognition / certification and registration to undertake a certain business activity.

Eligibility requirements

To be eligible for this lease you must:

  • be at least 18 years old
  • submit an environmental impact statement
  • submit details of proposed mining developments, including the type of minerals and description of the land
  • notify the landowner / occupier in writing within 21 days of lodging the application
  • provide particulars of your financial resources and access to technical resources
  • provide information regarding your estimated costs
  • publish a plan showing the location of the area applied for in local and State newspapers
  • display to the agency that an economically mineable mineral deposit exists in the specified area
  • enter into a compensation agreement prior to commencement of any mining with the landowner or occupier
  • provide details of the measures to be taken to minimise harm to the environment
  • pay a bond to ensure lease conditions are applied with, as specified by the agency.

You must also provide evidence that development consent has been granted before a mining lease will be approved.
