On-Premises Licence - New South Wales

Description

You will need this licence if you intend to sell alcohol for consumption on your premises in addition to another product or service, including food, entertainment and accommodation.

The licence applies to a variety of activities, including (but not limited to):

  • restaurants and cafes
  • accommodation venues (e.g. motel, bed and breakfast)
  • nightclubs
  • live music, arts and cultural events venues
  • catering services
  • cinemas, theatres and art galleries
  • hairdressers and beauticians
  • tourist facilities
  • sporting facilities.

This licence is not available where the primary business or activity carried out on your premises is the provision of entertainment by way of amusement machine, pool tables, poker gaming or jukeboxes.

A licence defines the need to obtain recognition / certification and registration to undertake a certain business activity.

Eligibility requirements

To be eligible for this licence, you must:

  • be at least 18 years old
  • be a fit and proper person
  • ensure your premises and facilities meet prescribed standards and requirements
  • provide a copy of the local council's development consent or approval for the premises (if required and approved)
  • undergo a police check and provide the certificate (if you are applying as an individual)
  • provide a community impact statement (CIS) if you are applying to operate a public entertainment venue
  • provide a copy of your Responsibly Service of Alcohol (RSA) certificate or competency card (if you are applying as an individual).

All businesses holding this need to meet the primary purpose test. If the primary purpose of the business or activity is the sale or supply of alcohol, you are not eligible for an on-premises licence.

All staff of the licensed premises must attend any required training for the purposes of the licence as specified by the Authority, including a responsible service of alcohol (RSA) course by a registered training organisation.

Duration

Remains in force until surrendered or cancelled.
