You may require this certificate if you intend to subdivide and develop land. It is required prior to registration if you intend to create, amend, consolidate or cancel a leasehold development or staged development.
The approval of a leasehold development enables the future registration of the specified property. A leasehold development is a development involving the registration of a series of lots which are to be leased, rather than purchased. Strata plans are property divided into lots (private property) and common property. The common property is managed by a body corporate, which is all the lot owners acting as a single body.
A leasehold staged development scheme is a development involving the registration of a series of strata plans that are to be leased.
This is part of a two-step approval process for leasehold developments, specifically:
- First you must obtain a certificate of approval in principle from the relevant consent authority; and
- You must lodge your leasehold development scheme with the relevant State Government Agency.
