Description

If you want to possess, cultivate, process or supply low THC hemp for commercial purposes, you will need this licence.

Low THC hemp refers to either hemp plant with a THC concentration in the leaves and flowering heads of not more than 1% or approved hemp seed. To supply low THC hemp means to distribute, give, trade or transport whether or not for money.

There are three types of licences:

  • commercial licence
  • class A research licence
  • class B research licence.

Licence

A licence defines the need to obtain recognition / certification and registration to undertake a certain business activity.

Eligibility requirements

To be eligible, you must:

  • be a suitable person to hold a licence. To be considered suitable, you must be fit and proper which means you have not been found guilty of an indictable offence involving dishonesty, found guilty indictable on specified drug offences.
  • live in Australia
  • be able to have a cultivation area of at least two hectares
  • not be affected by bankruptcy.

Ongoing eligibility requirements

If you are supplying live hemp plants, hemp tissue culture or viable hemp seed under this licence, you must provide a consignment notice to accompany the hemp.

Within 7 days after planting hemp, you must notify the department of the location of the planted hemp, including GPS coordinates.

You must provide an annual report to the Department describing your activities carried out under this licence throughout the year.

Up to 5 years.
