Cane railway approval - Burdekin Shire Council - Queensland

Description

You will need this approval to construct or operate a private railway for transportation of cane if the track passes along, across, under or over a road. Cane railways transport freshly harvested cane to a sugar mill for processing.

Railways are regulated by your local council to ensure that:

  • they are maintained and operated in accordance with appropriate safety standards
  • the council and the public are protected against loss or damage resulting from the operation of railways
  • use of a railway does not unreasonably disrupt or interfere with the use of roads and other infrastructure by the public.

Eligibility requirements

Before this approval is granted, you must have the following:

  • public liability insurance
  • indemnity for council
  • development approval.

Your approval may be subject to conditions, such as:

  • the standards and method of construction including best practices for stormwater, erosion and sediment control during construction and operation
  • requirements for safety precautions, signs, warning devices and guard rails
  • the standards and methods of operation and maintenance of any cane railway
  • requirements for the construction of any grids
  • drainage works
  • speed of operation
  • weight and nature of cane railway
  • maintenance of and repairs to roads or bridges adjoining or in the vicinity of the cane railway
  • access details for trucks.

Your cane railway must:

  • not cause any inconvenience, hindrance or damage to any person using the roads or bridges upon which the railway was constructed
  • not damage any roads or bridges
  • be operated and adequately guarded to protect the safety of any vehicle or pedestrian traffic.

  • pay the prescribed fee.

  • a detailed statement of when and how the railway is to be operated
  • a detailed statement of the purpose for which the railway is intended to be used.
