Cemetery permit - Cook Shire Council - Queensland


You will require a permit to operate a cemetery, which includes:

  • crematoriums
  • columbaria
  • mausoleums or vaults
  • gardens of remembrance
  • any other structures.

A licence defines the need to obtain recognition / certification and registration to undertake a certain business activity.

Eligibility requirements

An application for the permit can only be made by the person who will be undertaking the activity.

A permit will be granted if the activity:

  • doesn't result in harm to human health or safety or personal injury
  • doesn't result in property damage or a loss of amenity
  • doesn't result in environmental harm or environmental nuisance
  • doesn't result in a nuisance
  • complies with the provisions of local laws
  • complies with the assessment criteria
  • complies with the prescribed criteria.

Conditions which may be imposed on your permit include:

  • the operator keeps and maintains a publicly available register containing all relevant information concerning burials and cremations at the cemetery
  • all entrances to the cemetery are appropriately signed, including the opening and closing times, a detailed site plan, burial plot descriptions, and contact details of the permit holder
  • the cemetery operates in accordance with the administration and management plans and policies approved by the local government.

Ongoing eligibility requirements

In order to maintain this permit:

  • you must not dispose of human remains in a cemetery unless authorised by an approval issued by the cemetery authority
  • human remains brought into a cemetery must be in a coffin or other form of container of water tight construction
  • you must keep publicly available records about the disposal of human remains within the cemetery
  • you must have in place policies about matters such as the disturbance of human remains.

Application process


You may need to provide the following with your application for a permit to operate a cemetery:

  • proof of the approved development application for the use of the subject land as a cemetery
  • detailed plans of the site, indicating all roadways, buildings, other structures and all future burial plots
  • all administration and management policies, plans and standard operating procedures for cemetery operations (e.g. a vegetation maintenance plan, exhumation policy and records procedure)
  • details of any lease agreements, if applicable, with regard to grave sites, shrubs or memorials.

Additional information

Your local council may grant a permit if they are satisfied of the following criteria:

  • the council has received the completed application form and all relevant documentation
  • the proposal is consistent with rights that have been granted in accordance with any local law
  • the place where the remains of each person are proposed to be buried or place (but not if the remains are cremated remains that are to be scattered)
  • details concerning any other dealings with the remains after they have been buried or placed in the cemetery are provided and recorded by council and made available for public viewing upon request.
