Detached bottle shop approval - Queensland

Description

You will need this approval if you hold a commercial hotel licence and intend to open a detached bottle shop away from the main hotel premises. This approval allows you to operate up to three detached bottle shops.

You will be allowed to:

  • sell liquor to the public for takeaway purposes
  • supply liquor free of charge promotional samples to the public for consumption on the premises
  • The bottle shop must trade under the same trading name as the main hotel premises.

If your right to occupy a bottle shop ends, you will need to apply to change your licensed area.

Eligibility requirements

To apply for a detached bottle shop, you must already hold a commercial hotel licence.

To be eligible for approval, a detached bottle shop must:

  • be no more than 10km by road from the main hotel (unless the proposed bottle shop is in a remote area not serviced by takeaway facilities)
  • be operated by the licensee of the main licensed premises
  • have a floor area of not more than 150m2
  • have no direct access from any other business premises
  • have direct access from a public place
  • have no drive-through facility.

You must ensure that you:

  • have the sole right of occupancy of the bottle shop premises
  • will derive the financial benefit from the bottle shop premises
  • use the main hotel premises as your principal place of business
  • have not requested exclusivity to conduct a bottle shop at the shopping centre in the tenancy agreement.

Application process

To apply for this approval, you must submit the following:

  • Form 20: Application for a detached bottle shop
  • layout plan (scale 1:100)
  • location plan
  • prescribed fees.

If the bottle shop does not commence trading within 90 days of the approval date, the approval will lapse and a new application will be required.

Transfer process

Transfer

If one licensee holding a commercial hotel licence sells a bottle shop to another licensee holding a commercial hotel licence they may make a joint application to the Commissioner for Liquor and Gaming for approval of the transfer.

You can transfer your bottle shop by completing a Form 22: Application to transfer a detached bottle shop.

You should lodge your application for transfer six to eight weeks before the proposed settlement date to allow sufficient time for processing.

Please note that the new bottle shop operator has no authority to sell and supply liquor until a transfer is approved and the applicant has become the licensee.

Approval time

Applications take at least three to five months to process, longer if there are public objections.

Additional information

Many detached bottle shops are located within community shopping centres and are subject to the opening times of the centre. If earlier trading is required to suit the shopping centre hours, a separate application for approved extended trading hours must be lodged.
