Extractive industries approval - Lockhart River Aboriginal Shire Council - Queensland

Description

You will need this approval if you intend to carry on an extractive industry.

Extractive industry refers to the recovery or processing of extractive materials such as soil, sand, gravel, rock, stone or other materials extracted from the earth. This does not include regulated substances like coals, minerals or petroleum.

If you are extracting over 5000t of extracting materials per year, you will also require an environmental authority (EA).

A licence defines the need to obtain recognition / certification and registration to undertake a certain business activity.

Eligibility requirements

You must publish an advertisement at least once in a newspaper circulating in the Area to cause public notice of your intention to make an application and post a copy of the advertisement on the land in question. Please refer to the local law for more information.

Ongoing eligibility requirements

There may be specific approval conditions that require you to:

  • take specified measures to protect the safety of persons working on the site and others
  • regulate access to the site
  • fence the site and stockpile of extractive materials
  • regulate the accumulation of water on the site
  • regulate the time when operations or specific aspects of the operations (such as blasting) may be carried out
  • take specified action to prevent or minimise pollution (including pollution of land, water or air and noise pollution)
  • plant and maintain vegetation to screen the site and prevent or minimise visual pollution
  • rehabilitate the land affected by the operations carried out under the approval
  • give security for compliance with the conditions of the permit
  • keep specified records containing information of a specified kind.

Your application must:

  • be in writing
  • be accompanied by 2 copies of a plan showing:
    • sufficient detail to enable the Council to understand the nature of the proposed excavation
    • the location, together with the name and description of the occupier and / or owner of the land
    • the limits of the area proposed to be excavated
    • the depth and extent of the proposed excavation
    • the existing contours of the land
    • the estimated depth and description of the over-burden present
    • the location of any existing or proposed buildings, so far as is known.
  • clearly indicate the distance of the proposed excavation from adjoining drains, watercourses, roads, footpaths, buildings and other structures.
  • include such additional information concerning the proposed excavation, as the Council may reasonably require.
