You will need to comply with strict rules on where you allow your patrons to smoke if you operate a food and beverage venue. They cannot smoke in:
- any indoor area
- any outdoor area where food or drink is provided as part of the business.
Unlicensed premises may designate an outdoor smoking area, but it must be five metres away from any building entrance and food and drink must not be consumed in that area.
If you are a licensed liquor premises that holds one of the following licenses, you are permitted to have a Designated Outdoor Smoking Area (DOSA):
- commercial hotel
- commercial club
- commercial speciality facility.
In a DOSA, patrons may smoke and drink in a designated area, but eating is not allowed. Strict rules apply to all premises with DOSAs. If you choose to have a DOSA, you will be required to develop a smoking management plan for the entire premises.
