Description

You will need this licence if your business involves the handling of unpackaged food for sale.

Common examples include:

  • cafes, restaurants, and takeaway outlets
  • home-based food producers (jams, cakes, etc.)
  • mobile food vans, trailers or food boats
  • food stalls at markets and events.

A licence defines the need to obtain recognition / certification and registration to undertake a certain business activity.

Eligibility requirements

To be eligible for this licence, you must:

  • meet the requirements set out in legislation
  • provide any plans or drawings
  • appoint a Food Safety Supervisor who is available when the business is operating.

You may also need to have an accredited Food Safety Program.

If you intend to operate a water carrier as part of your mobile food business, you will need to follow the guidelines outlined in the authorising legislation.

It is advised that you talk to your council before applying.

The assessment of your application for a food business licence will consider:

  • if you have the appropriate approvals or permits for your food business (for example, planning and development approvals, footpath dining permits)
  • if you have the appropriate skills and knowledge to run a food business
  • if you have had a previous food business licence suspended or cancelled or been refused
  • if the design and fit-out of your premises is appropriate for the type of food business you are operating
  • if you need a food safety program, that it has been developed and submitted with the application
  • if you have a food safety supervisor.
