Requirements for this licence vary within the council areas.
A food business that provides tables and chairs on public land for outdoor dining in the following examples requires an approval from Council:
All outdoor dining facilities provided on land under the control of council.
- approval will only be granted for outdoor dining on footways adjacent to licensed food businesses.
- tables must not exceed 1.5 square metres in area and be stable, safety constructed, properly secured and in good order.
- chairs and tables must be located so that a clear unobstructed pedestrian corridor of at least 1.8 metres in width is provided on the footway and must also be at least 0.8 metres from the edge of the footway where it adjoins the road.
Cafes, restaurants, snack bars, coffee shops and the like who provide amenities on the footpath for the consumption of food and drinks by their clients.
