Higher risk personal appearance service licence - Pormpuraaw Aboriginal Shire Council - Queensland

You will require this licence if you have a business which provides higher risk personal appearance services. Higher risk personal appearance services refer to skin penetration procedures in which the release of blood or other bodily fluid is an expected result.

Examples of higher risk personal appearance services include:

  • body piercing
  • cosmetic tattooing
  • tattooing
  • tattoo removal using micro needles.

You can only provide these services from the premises stated on the licence.

Service type

A licence defines the need to obtain recognition / certification and registration to undertake a certain business activity.

Eligibility requirements

If you intend to operate higher risk personal appearance services, your business should be designed and constructed to:

  • be adequate for the types of services and activities conducted
  • provide adequate space for all activities and for all equipment to be used or stored
  • allow easy cleaning / sanitising and sterilising procedures of all structures and equipment.

Your premises must be designed so that the flow of service is in one direction: from product receipt, to storage, preparation, providing the customer with a service, and finally to disposal and / or sanitising and / or sterilising of equipment. This is to reduce the infection risks associated with the process.

Your business must also include:

  • a clean zone within a room, or rooms, where clean or sterilised items are stored and a hand basin is located
  • a dirty or contaminated zone within a room, or rooms, where contaminated items are placed to await cleaning, and where the cleaning sinks, instrument washers and sterilisers are located.

You may also require development approval if you are conducting the following activities:

  • starting a new personal appearance service business
  • changing the type of activity (e.g. from office space to tattooist)
  • re-establishing a personal appearance service business that was abandoned
  • changing the scale or intensity of an existing business (e.g. increasing the number of chairs or expanding into the next unit)
  • carrying out building work
  • carrying out plumbing or drainage work.

Businesses may have in place a COVID Safe Framework. This refers to:

  • where there is an approved plan for the business, activity or undertaking
  • where there is no approved plan and a COVID Safe Checklist is in place
  • where the business elects not to operate under an approved plan and instead elects to use a COVID Safe Checklist.

As of 20 October 2020, if your business is following an industry COVID Safe Plan, you will be able to offer services to the maximum number of people you can fit on your premises. You must comply with the rule of having one person per four square metres for indoor spaces greater than 200 metres. Smaller indoor spaces less than 200 square metres can have one person per two square metres, up to a maximum of 50 people at a time. Businesses must ensure everyone is kept 1.5 metres from others (outside their family or group) where possible. This is to be maintained by all workers and visitors.

Businesses which elect to not have in place a COVID Safe Framework may only operate the business for a maximum of 50 people, with no more than one person per four square metres and physical distancing observed.

Personal appearance businesses must collect contact information from patrons, contractors, and staff. This is for contact tracing purposes and the information must be destroyed after 56 days.

Offences exist in relation to higher risk personal appearance services. Legislative requirements must be complied with to ensure you are not in contravention of any legislative provisions.
