Mining claim - Queensland

Description

You will require this claim if you intend to conduct small scale mining operations such as prospecting and hand-mining for minerals. There are two categories of licence:

  • mining claim - any mineral other than coal and uranium
  • prescribed mining claim - limited to corundum, gemstones or other precious stones

This licence prohibits the use of machinery to prospect, explore or mine.

You may not need to apply for an environmental authority if you have a relatively low environmental impact and meet the eligibility criteria for small-scale mining activity.

Changes to mining claim applications - Mining claims are being reviewed as part of the draft Queensland resources industry development plan. A moratorium on new mining claim applications is in place from 25 November 2021 until a future policy is finalised. During this time no new mining claim applications will be accepted. A licence defines the need to obtain recognition / certification and registration to undertake a certain business activity.

Eligibility requirements

To be eligible you must:

  • complete a security self-assessment
  • address any native title requirements
  • notify landholders about the application and provide them with particulars
  • come to an agreement with landholders in regard to compensation.

A mining claim will only be issued for an area of one hectare or less for a mining claim and 20 hectares or less for a prescribed mining claim. Other restrictions may apply in restricted areas.

You may make an application for a mining lease electronically using the MyMinesOnline system. Alternatively you may complete the application form and submit with any attachments and the prescribed fee at a Mines lodgement office.

This claim can be transferred. The new claim holder must:

  • be an adult
  • if a company, comply with the meaning under Corporations Law
  • not hold more than two mining claims in Queensland.
