Notification of building and construction work - portable long service - Queensland

Description

You will are required to notify QLeave if you intend to carry out building and construction work in Queensland (including maintenance), where the total cost of work is $150,000 or more (excluding GST).

You must notify them prior to being issued a development permit, or if no development permit is given, before the work starts.

QLeave registration is free to employers and workers. The Portable Long Service Leave Scheme is funded by a levy imposed on the total cost, whether direct or indirect, of building and construction work in Queensland costing $150,000 or more (excluding GST). The levy is paid in conjunction with the Building and Construction Work Health and Safety (Queensland) levy and the Construction Skills Queensland levy.

A licence defines the need to obtain recognition / certification and registration to undertake a certain business activity.

Exemptions

You will be exempt for the levy if you are carrying out work under an owner-builder permit. You also may be exempt if you are not substantially engaged in the building and construction industry. QLeave will, at its discretion, consider a range of indicative criteria when determining whether building and construction work is discrete work or part of broader works:

  • the person, or entity, for whom the work is to be done
  • the financial investment decision (FID) relating to the work, including commencement and completion and/or ???notice to proceed?? of the work (staged, independent decisions or otherwise)
  • the location of the work, for example a parcel of land purchased or leased for a purpose, alternatively the geographic concentration or dispersion of the work
  • the nature, purpose and relatedness of the individual items of work to the core work
  • the time frame and/or stages of the work
  • the description of the work in published documents, including publications from other government Departments and agencies,  LGAQ, BIS Shrapnel and Cordells and/or company EIS reports
  • the nature of the workforce involved in the work
  • local, State and Federal government approvals for the work.

QLeave may take several, or all of the indicators into consideration when making its decision.

QLeave registration is free to employers and workers. The fee is funded by a levy.

Currently, the combined levies is 0.475% of the total cost of the building and construction work which equates to $4.75 for every thousand dollars (or part thereof). Of this, $1.25 is paid directly to Workplace Health and Safety Queensland and $1.00 is paid to Construction Skills Queensland to provide industry training. The remaining $2.50 is invested to provide ongoing funds for long service leave entitlements.
