Commercial activity permit - Queensland

Description

You will need this permit if you intend to conduct activities for commercial benefit, gain or profit in a national park, another protected area, State forest or recreation area. This can include fundraising activities by not-for-profit organisations.

Specifically, a permit is required if any of the following apply:

  • the primary purpose of the activity is to make a profit
  • the activity, tour, course or transport is provided free of charge, but in conjunction with another commercial product or service
  • the service is being provided by someone who is being compensated or paid a fee (e.g. a tour guide or group leader)
  • the activity is ongoing or regular
  • an entry or participation fee is being collected over and above those costs associated with conducting the activity
  • the activity is open to the public as well as a specific membership group.

Examples of activities include:

  • guided tours
  • events
  • filming and photography
  • canoeing, rafting or kayaking tours or hire services
  • fundraising and charitable events
  • hang-gliding or paragliding
  • scenic flights
  • vending (e.g. mobile food vending)
  • scuba diving
  • motorised activities.

A licence defines the need to obtain recognition / certification and registration to undertake a certain business activity.

Eligibility requirements

To be eligible for this permit, you must have the following insurance:

  • workers compensation insurance or equivalent
  • public liability insurance for $20 million
  • any other activity-specific insurance and indemnity requirements.

Ongoing eligibility requirements

You must submit a return of operations within 20 business days of the end of each quarter.

Duration

This permit remains in effect for a maximum period of three years, depending on the applicant's requirements. Permits can be renewed if the operator is planning to continue in exactly the same manner, with no increased capacity and new sites. A renewal fee and permit fees are payable.
