Wine producer licence - Queensland

Description

You will need this licence to operate a vineyard or winery.

You will be allowed to sell your wine:

  • for tasting on the premises as a sample or for consumption on the premises other than as a sample
  • for consumption off the premises (takeaway)
  • at other premises (satellite cellar door) for consumption on or off the other premises.

You may also be allowed to sell wine other than your own:

  • for consumption on the licensed premises
  • for consumption off the licensed premises but only if the sales do not exceed the sale of the licensee's wine (e.g. no more than 49% of annual sales).

You may hold more than one licence, but must have a separate wine nominee for each premises.

You will need to have an approved wine nominee for your premises and be a fit and proper or suitable person.

Ongoing eligibility requirements

You are required to pay annual licence fees, which are due each year by 31 July. You can pay your annual fees through the Office of Liquor and Gaming Regulation client portal.

You are also required to lodge an annual return listing the wine you have produced, sold, purchased and blended. You must lodge your annual return online through a separate Liquor, Gaming and Fair Trading portal. There's no need to log in to complete your annual return, just click on the 'Liquor or Gaming Return' tile.

To apply for a new licence you must submit the following:

  • Form 1: Application for a wine producer licence
  • Form 5: Personal details schedule (wine)
  • all required attachments
  • prescribed fees.

In addition to the above, all applicants must undergo a criminal history and other relevant probity checks to hold a wine licence. You may also be required to advertise your licence application.
