Poppy Cultivation Licence - South Australia

Description

You will need a licence if you intend to cultivate alkaloid poppies in South Australia for commercial purposes relating to therapeutic use or for research purposes relating to non-therapeutic use.

Alkaloid poppies contain opiates such as morphine, codeine and thebaine used for pain relief and other medications.

You will be authorised under this licence to:

  • cultivate or possess alkaloid poppies
  • sell or supply poppy straw to a licensed processor at specified premises (commercial licence)
  • supply alkaloid poppies or poppy straw to a licensed processor (research licence)
  • conduct measurements, analyses and extractions, including extractions of alkaloids from poppies, for chemical analyses at specified premises (research licence).

You will need a separate licence if you intend to undertake poppy processing.

A licence defines the need to obtain recognition / certification and registration to undertake a certain business activity.

Eligibility requirements

You will need to contact the current processor licensed in South Australia to register your interest. You will need to have entered into a contract with the licensed processor (subject to the grant of a cultivation licence) before you receive and complete your licence application.

You will need to complete a National Police Check to be eligible for a poppy cultivation licence.

You will need to provide evidence that the activity you intend to undertake is either a:

  • legitimate commercial activity relating to the therapeutic use of alkaloid poppies
  • research activity relating to the non-therapeutic use of alkaloid poppies that is to be conducted by a person with appropriate scientific training and using appropriate methodology.

You will need to be a fit and proper person to hold a poppy cultivation licence. You may be considered a fit and proper person to hold the licence if:

  • neither you nor any of your associates has been found guilty of a serious offence in or outside South Australia in the past 10 years
  • you and each of your associates is a suitable person to be involved in the cultivation of poppies
  • your property or premises will be suitable for the cultivation of alkaloid poppies, including location, facilities and proposed security arrangements.

Your application may also be assessed according to:

  • whether you and your associates are of good repute, having regard to character, honesty and integrity
  • whether you have a stable financial background
  • whether there is a satisfactory ownership, trust or corporate structure in place.

Ongoing eligibility requirements

You will need to comply with the risk management plan under the licence.

You will need to comply with any condition of or restrictions on the licence, including with respect to:

  • species of alkaloid poppy to be cultivated
  • specific premises at which activities authorised under the licence are to be carried out
  • security, surveillance and restricted access requirements
  • record keeping
  • proper disposal and destruction of harvested material and crop residue.

You will need to issue an employee identification certificate to each employee employed to carry out activities in your poppy cultivation business.

You will need to have registered your interest and entered into a contract with the current licensed poppy processor in South Australia (subject to the grant of a cultivation licence). You will then need to contact the agency to by phone or email to receive the licence application form. You will need to lodge the completed application with supporting documentation and fee payment with the agency.

Transfer

This licence cannot be transferred.
