Restaurant Licence - South Australia


A Restaurant Licence authorises the licensee to sell liquor for consumption on the premises at any time with or ancillary to a meal provided by the licensee, or for consumption on the premises by persons, seated at a table or attending a function at which food is provided.

The licensee may apply for Section 34(1)(c) a condition that allows the supply of liquor without a meal. If the restaurant wants, patrons may provide their own liquor for consumption (BYO).

The Licensing Authority must be satisfied that the proposed premises are suitable, have all the necessary planning and building approvals, applicants are suitable, that the granting of the licence will not cause any undue offence or annoyance to those who work, worship or reside in the locality, and that the licence category is suitable for the activity proposed. The licensing authority may refuse an application for a licence, but instead may grant a certificate of approval for the proposed premises.
