A tobacco product is anything that contains tobacco or is designed for the purpose of smoking tobacco (e.g. cigarettes, rolling tobacco, herbal cigarettes, cigarette papers, etc). An e-cigarette product is a device that is designed to generate or release aerosol or vapour for inhalation by its user in a manner similar to the inhalation of smoke from an ignited tobacco product. An e-cigarette product includes parts designed for an e-cigarette (e.g. battery, heating element, or vapour).
It is a requirement that you display a copy of the licence and a prescribed notice next to each point of sale.
The approved number of tobacco and e-cigarette points of sale are restricted to one, unless the retailer also holds a certain class of liquor licence.
If you intend to sell tobacco or e-cigarette at more than one retail outlet, you must hold a separate tobacco and e-cigarette licence for each of these outlets.
It is illegal to sell e-cigarette products (commonly called vapes) containing nicotine unless the business is a pharmacy because they require a prescription for use. It is the responsibility of the retailer to ensure that e-cigarette products do not contain nicotine, regardless of whether this is disclosed on the packaging.
