You will require a certificate of substantial compliance from a building surveyor for any completed or partially completed work if the work either:
- fails to comply with legislation
- is subject to a building order relating to illegal building work.
The building surveyor will evaluate whether the work is classified as illegal and is therefore eligible for a certificate of substantial compliance. A building surveyor may grant a certificate of substantial compliance if satisfied that the work either:
- substantially complies with legislation
- does not comply fully with legislation but non-compliance is not detrimental to the health and safety of any current or future occupants of the building.
