Agent's Representative - Real Estate Agent - Victoria

Description

You will require this authorisation if you are employed by a real estate agent and intend to act as that agent's representative.

You may perform any of the functions of an estate agent under the authority of that estate agent, including acting as a sales person or property manager. However, this authorisation does not allow you to operate or control a real estate business.

An agent's representative working as a branch manager for an estate agent cannot work for another estate agent.

A licence defines the need to obtain recognition / certification and registration to undertake a certain business activity.

Eligibility requirements

To be eligible for this authorisation you must:

  • be at least 18 years old
  • have a registered address in Victoria
  • have passed, in the last five years, the course in Real Estate for Agents' Representatives or an equivalent course, and show evidence of that
  • have held a real estate licence or worked as an agent's representative within the last ten years.

You will also need to apply for special permission to be employed as an Agent's Representative if:

  • a claim has been admitted against you from the Victorian Property Fund
  • you have, within the last 10 years, been convicted or found guilty of any offence involving fraud, dishonesty, drug trafficking or violence which is punishable by imprisonment for three months or more (whether or not a sentence of imprisonment was imposed)
  • you are insolvent under administration.

It is an ongoing requirement of this licence that you comply with all current industry codes of practice, and abide by any conditions or obligations issued by the Agency.

You must comply with the rules of professional conduct for agents representatives and your employer must report any change of registration details to the Agency within seven days.

Your employing estate agent must complete your employment notification form to the Agency.

Disqualified persons or entities

You will not be eligible to register as an estate agent if you:

  • be a represented person under guardianship legislation
  • be subject to a Victorian Civil and Administrative Tribunal declaration making you ineligible to act as an agent's representative
  • be subject to an order by any regulatory body disqualifying you from acting as an agent's representative.
