Authority for an Extractive Activity - Victoria

Description

You will need this authority to carry out an extractive activity. An extractive activity means the removal or sale of soil, sand, gravel or stone to a depth of two metres below the surface. It is classed as an extractive activity if the total area of surface broken is greater than 2000 square metres.

This authority does not apply if the extractive activity is:

  • carried out on Crown Land
  • authorised under other legislation
  • solely for the purpose of grading land for primary production.

The application for this authority must be made by the manager of any potential extractive activity site.

A licence defines the need to obtain recognition / certification and registration to undertake a certain business activity.

Eligibility requirements

To be eligible for this authority, you must make a written application that:

  • describes the land where the activities will take place
  • states the extent of the area or areas to be broken up
  • gives details of the activities that will be carried out
  • if the site manager is not the owner, describes how the land will be accessed
  • is accompanied by the required application fee.

An authority will not be granted unless the activity is consistent with any applicable land use conditions or land management notices.

Ongoing eligibility requirements

The authority may impose some conditions concerning:

  • land rehabilitation
  • access to the land
  • how the activity is carried out
  • lodgement of a bond
  • prevention or minimisation of land degradation
  • materials that must not be removed.

Duration

For a period not exceeding five years
