Licence or Lease Over Cemetery Land - Victoria

Description

You will need this agreement if you intend to use any part of the land in a public cemetery for private or public purposes (including offering services).

Depending on the intended activity, you may require a licence or lease arrangement:

  • licence: the licensee does not have the right to exclusive use of land and / or premises and may have to share occupation with the licensor and third parties or may only be able to use the licensed area at certain times
  • lease: a lease is appropriate when the tenant requires exclusive use of land and/or premises for the permitted use.
