Occupancy Permit - West Wimmera Shire Council - Victoria

Description

An occupancy permit is generally required upon completion of building work undertaken in accordance with a building permit. The building permit will specify if an occupancy permit is not required, in which case a certificate of final inspection will be required.

The occupancy permit is evidence that a structure is suitable for use. The permit will specify conditions on the use of the structure, such as the maximum number of people it can accommodate, and safety measures that must be implemented.

Some temporary structures require an occupancy permit from the Agency before they can be used for public entertainment.

These structures include:

  • tents, marquees or booths with a floor area greater than 100 metres squared
  • seating stands for more than 20 people
  • stages or platforms (including sky boarders and stage wings) exceeding 150 metres squared in floor area
  • prefabricated buildings exceeding 100 metres squared other than ones placed directly on the ground surface.

Public entertainment:

  • includes events which can be accessed by the public, with or without tickets
  • does not include private or invite only events
  • does not include use for other purposes such as retail, dining, office space etc.

Eligibility requirements

To eligible for this permit, you must:

  • ensure that the building is suitable for occupation from a safety perspective
  • lodge a completed form with the building surveyor who issued the building permit
  • pay any lodgement or approval fees.

An occupancy permit will not be issued unless the building is suitable for occupation, and a compliance certificate has been obtained for any plumbing work carried out in conjunction with the building work. Please note that particular requirements may apply to the type of building and the type of work carried out.

Ongoing eligibility requirements

Periodic inspections may occur in relation to places of public entertainment to ensure compliance with occupancy permit conditions. Any failure to comply may result in the permit being amended or cancelled.

A building surveyor may refuse application if additional information that has been requested is not supplied.
