You will only need this permission if you intend to operate as a debt collector, and you fall into a category of prohibited person or corporation.

A debt collector is any person or corporation that engages in debt collection for remuneration or reward. This includes either collecting or requesting payment of debt, or repossessing goods or property other than real estate.

Disqualified persons or entities

As an individual, you are prohibited to operate as a debt collector if you:

  • are under 18 years of age
  • are insolvent
  • have held a private security licence that has been cancelled or suspended in the previous five years
  • have been found guilty or convicted of an offence involving fraud, dishonesty, drug trafficking or violence punishable by imprisonment of three months or more in the previous five years
  • have been found to have been involved in use of physical force, undue harassment or coercion in the previous five years.

As a corporation, you are prohibited if you:

  • are an externally administered body corporate
  • have at least one director who is a prohibited person
  • are managed or effectively controlled by a prohibited person
  • have in the previous five years been found guilty or convicted of prohibited debt collection practices.
