Description

You may require this permit if you intend to use or develop land, or change the use or development of land which is subject to the relevant planning scheme. A permit is not always required as some planning schemes allow some changes in land use without the need for a permit, provided conditions are met. 

The relevant council is normally the first point of contact for permit applications.

You can apply for straightforward planning permit applications via VicSmart.  This is a streamlined assessment process for planning permits for proposals that involve minor subdivisions, buildings and works, tree removal and lopping, small advertising signs, and car parking reductions.

Eligibility requirements

To be eligible for this permit your application must contain the fee and sufficient information to show that the proposed planning changes will comply with current legislation and planning schemes.

Your application should be made on the approved form clearly stating and / or accompanied by the following details:

  • name and address of applicant
  • address of land, title particulars, plan showing land or any combination of these
  • the existing use of the land and the proposed use and development
  • the estimated cost of the development
  • any additional information required by the planning scheme such as copies of any registered restrictive covenant and other identifying information.

The approval process involves consideration of your proposed use or development against zoning and planning controls that apply in your municipal area (both Local and State government).

There is mandatory notice and time requirements before approval for a planning permit may be given and it may be granted subject to conditions. The process may be complex and you should seek expert advice or consult with the council for further advice and assistance.

Duration

Up to two years. An extension of three months may be granted.
