Variation to Environment Management Plan - City of Melbourne - Victoria


The owner or occupier of premises may apply to the Council to vary the Environment Management Plan (EMP) that applies to their premises where they believe that, because of the nature of the activities conducted at the premises, the EMP currently in force is not appropriate.

EMPs promote responsible management of the environment throughout the municipality. Activities which may require you to vary your EMP include:

  • waste management and disposal
  • open fires
  • creating noise
  • creating strong odours and fumes.

A licence defines the need to obtain recognition / certification and registration to undertake a certain business activity.

Eligibility requirements

In determining whether to grant a variation to the Environment Management Plan, the Council may take into account the following:

  • the reasons given for making the application
  • any reports or submissions on the application by an authorised officer
  • your particular circumstances
  • the nature of the activities conducted on the premises
  • the environment of the neighbourhood within which the premises are located
  • any other related matter the Council considers relevant.

Ongoing eligibility requirements

Ongoing requirements may apply as a result of the variation of the EMP. Any person who does not comply with the details of their EMP risks a fine.
