Aboriginal Cultural Heritage Permit - Victoria

Description

You will need this permit to undertake one of the following activities:

  • disturb or excavate land to uncover Aboriginal cultural heritage
  • rehabilitate land at an Aboriginal place
  • bury Aboriginal ancestral remains at an Aboriginal place
  • carry out research on an Aboriginal place
  • carry out an activity that will, or is likely to, harm Aboriginal cultural heritage
  • sell an Aboriginal object
  • remove an Aboriginal cultural heritage object from Victoria.

It is illegal to do anything that harms Aboriginal cultural heritage, unless the activity is carried out in accordance with an approved cultural heritage management plan or cultural heritage permit. Cultural heritage permits are designed to allow smaller activities that may harm Aboriginal cultural heritage to proceed while minimising any negative impacts.

Aboriginal cultural heritage means Aboriginal places, Aboriginal objects and Aboriginal human remains. An Aboriginal place is any area of Victoria that is of cultural heritage significance to the Aboriginal people of Victoria. An Aboriginal object is any object of cultural heritage significance to the Aboriginal people of Victoria, or an object that has been removed or excavated from an Aboriginal place.

This permit will not be granted in relation to Aboriginal human remains or a secret or sacred object.

Eligibility requirements

To be eligible for this permit, you must:

  • submit an application form
  • be a person of good character
  • comply with conditions that may be required by the Agency or a registered Aboriginal party
  • pay any required fees.

The Agency may refer your application to a registered Aboriginal party responsible for the relevant Aboriginal place.

Ongoing eligibility requirements

Any activity carried out under this permit may be supervised by a cultural heritage advisor.
