Extractive Industry Licence - Shire of Esperance - Western Australia

Description

You will require this licence if you intend to operate an extractive industry. An extractive industry involves the quarrying and excavation of stone, gravel, clay, limestone, loam and other materials. This includes activities associated with the extraction process, such as:

  • stripping vegetation and top soil
  • stockpiling, excavating and earthworks
  • loading of trucks and associated vehicle movements
  • blasting rehabilitation.

This licence is required for all land other than Crown Land. However, it does not apply to the extraction of minerals authorised under mining legislation, or to a land owner extracting materials from their own land whose sole purpose is to use those materials on that land. You may also be required to obtain planning approval to operate your extractive industry.

A licence defines the need to obtain recognition / certification and registration to undertake a certain business activity.

Eligibility requirements

To be eligible for this licence you must:

  • notify owners and occupiers of adjoining land
  • notify every authority or person having control or jurisdiction over items within 500 metres from the boundaries of the land, or within an area determined by the local government as likely to be affected by the granting of a licence
  • provide copies of a plan of the excavation site containing the information required by the Agency
  • provide copies of a works and excavation programme containing the information required by the Council
  • provide copies of a rehabilitation and decommissioning programme
  • provide evidence that a datum peg has been established on the land related to a point approved by the local government on the surface of a constructed public thoroughfare or such other land in the vicinity
  • provide a certificate from a licensed surveyor certifying the correctness of the datum peg and excavation site plan
  • obtain all land use planning approvals required, and environmental approval if required
  • provide any other information required by the Agency.

You may be required to pay a bond, or provide a bank guarantee or other security to the council for the purpose of ensuring that the excavation site is properly restored or reinstated.

Before a licence is issued, you will be required to take out a public liability insurance policy in the joint names of the licensee and the local government. This insurance must indemnify the licensee and the local government for a sum of not less than $10 million in respect of any one claim relating to any of the excavation operations.
