Special Facility Liquor Licence - Western Australia

Description

You will need this licence if you intend to sell and supply liquor for a purpose not covered by any liquor licence. The purposes form licence subclasses comprising:

  • amusement venue
  • auction
  • bed and breakfast facility
  • catering
  • foodhall
  • online wine sales
  • reception or function centre
  • room service restaurant
  • sports arena
  • theatre or cinema
  • tourism
  • transport
  • vocational and education training course
  • vocational and education training institution
  • works canteen.

Licence

A licence defines the need to obtain recognition / certification and registration to undertake a certain business activity.

Eligibility requirements

To be eligible for this licence you must:

  • be at least 18 years old
  • be a fit and proper person
  • ensure that each person interested in the application or in the business or the profits or proceeds of the business is a fit and proper person
  • ensure your business will not cause undue offence, annoyance, disturbance or inconvenience to people who live, work or travel through the vicinity of your proposed premises
  • ensure your premises is suitable for the sale and supply of liquor
  • have the suitable planning and health certifications for your premises
  • demonstrate that your business aligns with your type of licence.

If you intend to sell or supply packaged liquor, your premises must:

  • have a retail section less than 400 square metres
  • not be located within 5km (in a metropolitan area) or 12km (in a regional area) of an existing packaged liquor store (hotel, tavern, liquor store and certain special facility licensed premises) with a retail section greater than 400 square metres.

If you intend to apply as a body corporate, each person who occupies a position of authority must be a fit and proper person.

If you intend to apply as an unincorporated body of persons who will not be joint licence holders, the body must:

  • have a common interest of political, literary, sporting, social or other lawful nature and that the supply of liquor is incidental to associating
  • appoint a trustee (who must be a fit and proper person).

Ongoing eligibility requirements

Depending on your type of licence, you may need to:

  • maintain a record of all transactions involving the sale or purchase of liquor
  • submit a return of all liquor transactions made during the previous financial year on or before 31 July each year.

Duration

Indefinite subject to retaining the same premises and paying the annual licence fee.
