Registration of Patent Attorney - Australian Government

Description

You will require this registration if you intend to practise as a patent attorney in Australia and / or New Zealand. Registration as a patent attorney allows practitioners to undertake the full range of functions available under the legislation, including rights to practice and to title and allows clients to claim a right of privilege for communications with their attorneys. With limited exceptions, only registered patent attorneys are allowed to undertake patents work in Australia and / or New Zealand.

A company may register as an incorporated patent attorney.

Eligibility requirements

To be eligible for this licence you must:

  • hold a level 5 or higher qualification in the Australian Qualifications Framework (or the New Zealand Qualifications Framework) which has a suitable depth of study in a field of science or technology that contains potentially patentable subject matter
  • have the knowledge of intellectual property law and practice that is required for a person to practise as a patent attorney
  • not have been convicted of a prescribed offence during the past five years or be under a sentence of imprisonment for dishonesty
  • be of good fame, integrity and character
  • provide a statement of skill from a registered patent attorney with at least five years post-registration experience
  • have been employed in Australia and / or New Zealand for two continuous years within five continuous years in a relevant position.
