Registration of an Opal Development Lease - South Australia

Description

You will need to register an opal development lease to prospect or mine an area for opal or other precious stones, and to recover and sell opal or other precious stones from that area. An opal development lease may be up to 40,000 square metres in area.

Registration of your claim will provide you with an exclusive right to:

  • recover and sell opals and other precious stones from your claim area
  • peg out an area for a precious stones claim within the area of your lease.

Eligibility requirements

To be eligible for registration you must:

  • have a current precious stones prospecting permit
  • peg out your claim.

You may not peg an opal development lease within a precious stones field unless the land is:

  • within a designated area
  • not within 500 m of a registered tenement at the time of pegging
  • not over ground previously disturbed by mining operations.

Your application for an opal development lease will be assessed according to the suitability of the land for a lease, and will involve an inspection of the area.

You cannot have more than one area pegged out for an opal development lease at any one time.

3 months and non-renewable

Expiry

When your opal development lease lapses or is surrendered, you may not re-peg another lease on land within that lease. Further, you cannot peg out a lease on land for at least 30 days after the previous lease has ended.

If the area is not wholly within a precious stones field, you must give the owner of the land notice of your application within 14 days after making the application.

An application for registration must be made within 14 days after the area is pegged out.

Transfer

You cannot transfer this lease.
