You will require this registration if you intend to practice as a trade marks attorney.

Anyone has a right to submit trade mark applications on behalf of themselves or another person. Only registered trade marks attorneys can describe themselves as trade marks attorneys. Only registered trade marks attorneys, patent attorney or lawyers can describe themselves as trade marks agents. Registration allows you to claim the full range of functions available under legislation and allows clients to claim a right of privilege for communications with their attorneys.

A company may register as an incorporated trade marks attorney.

Eligibility requirements

To be eligible for this licence you must:

  • hold a level 5 or higher qualification in any field of study specified in the Australian Qualifications Framework
  • have the knowledge of intellectual property law and practice that is required for a person to practise as a trade marks attorney
  • be of good fame, integrity and character
  • not have been convicted of a prescribed offence during the previous 5 years
  • not be under sentence of imprisonment for a prescribed offence.

Ongoing eligibility requirements

Proof that you have undertaken continuing professional education is a requirement to continue to be eligible for this licence.
